Family problems are common in every household, after all we are humans and humans have conflicts. Domestic Violence charges is a way for the government to protect victims in their home from an abusing and dangerous often environment.  The Government hopes that by being able to interving, into the problem, at an early stage, it can prevent a greater harm to the person - death.

The Government's goal is sincere, but in it's effort to protect the true victim's, it has also created a large net that captures families that are not really in need of intervention from our Government.  Believe it or not, there are people who will call the police and make up stories in order to retaliate against the their spouse or significant other.  Remember, the Government would rather err in the side of caution.  Again a novel idea, but the problem is that it causes havoc in families that get caught in the net, that are really not in need of assistance. The last issue is that there is a huge incentive for Counties to prosecute domestic violence cases because the County programs are all partly funded by the fine amounts imposed on individuals that are convicted of domestic violence charges.

The last issue in theses cases is the amount of freedom that is taken from the citizens as we allow the Government to dig deeper and deeper into our most precious sanctuary - our home.  There are some who believe that the Government has gone to far.  That forcing people into counseling for domestic violence charges is not the Governments role.  There are also those who believe that it is fine to give up some of our liberties in order to prevent a greater harm.  So, where ever you are on this spectrum, it really does not matter.  The Government has a strong hand policy when it comes to domestic disputes and domestic violence charges.

Domestic Violence charges can range from misdemeanors to felonies, it all depends on the gravity of the offense. It is also at the District Attorney's discretion as to how the case will be charged.  Some victims often regret making the initial claim, many because they know the allegations they made were not true, and attempt to get the District Attorney not to proceed forward with the case.  This is a hollow effort, as most District Attorney's in the state will continue forward with the domestic violence case even if the alleged victim does not want to prosecute, regardless of the reason.

The charges are contained in the California Penal Code sections 273.5, 243, 242.  If you are charged with one of these sections, do not be intimidated into pleading guilty, or accepting an offer before you talk to a Domestic Violence Defense Attorney.  If you have been charged with domestic violence in the cities of Oakland, San Francisco, Marin County, Hayward and are in need of a Domestic Violence Attorney, then you should call Attorney Francisco Rodriguez, at (415) 378-4133 for a free consultation.
